David Uweze Umahi, (Engr), Minister of Works of the Federal Republic of Nigeria

Does the Minister of Works of the Federal Republic of Nigeria, Engr David Uweze Umahi, realise that the debt that his harasser is claiming is already statute-barred?

A debt not claimed in the court of law within the first six years of its lifespan is presumably forgiven and forgotten before the eyes of the law.

Once this period lapses, the creditor loses the right to enforce the debt through the court. However, the debt becomes live, if the debtor acknowledges the debt or makes a part payment within the six years, the time starts running again.

The Limitation of Statute Law provides in Section 18 that an action for recovery of debt cannot be brought after six years. As a result, the actions of the lady against the minister are ultra vires and highly crude.

However, it is important to note in the decision established in Madaki & Anor v. GTB & Anor (2022) that the Police are not debt recovery agents and cannot interfere in purely civil contract disputes.

A minister of the Federal Republic of Nigeria should always avail himself of the briefings of legal personnel for proper defence and conduct befitting someone in such an exalted public office and sustained on the taxpayers’ money
