Sequel to the appeal filed by the management of Omni-Blu Aviation, OBA, a private initiative startup, which has for a decade been making its modest impact incognito, in air charter and aviation facility management business, has now been absolved of all encumbrances to her lawful enterprise.

Given the clean bill of health to OBA was the regulatory authority for air transport in Nigeria, the Nigerian Civil Aviation Authority, NCAA, through its letter dated 28th of February 2025, with ref: NCAA/DGCA//DLS/CS/2025/013.

The NCAA letter was a response to the appeal filed by Omni-Blu, against the miscarriage of justice, although inadvertently by the NCAA, as the earlier verdict was at variance with equity, fairness, hence justice was served by the reversal letter.

On re-examination of further verifiable information and the other fact adduced by the appellant, OBA, the Nigeria CAA as an independent and unbiased arbitrator, weighed all the evidences before it and had to make a detour.

The bone of contention was that Nigeria CAA initially found OBA and Eastwind Aviation Limited severally and collectively culpable in the “download analysis and issuance of the falsified readout report for avionics equipment on the Sikorsky S76C+ helicopter with MSN 760486 and Reg. Mark 5N-BQG”.

The findings culminated in its earlier verdict which sanctioned OBA vide an NCAA letter dated 30th of January 2025, where-in the Nigerian Civil Aviation Authority (NCAA) claimed to find OBA culpable on allegations of infringement of Part 1.2.1.5 Nig.CARs, and as such revoked Omni-Blu Aviation Limited (Omni-Blu) Air Operator Certificate (AOC).

However, further evidence adduced in the appeal succeeded in assisting the NCAA to decipher that there was no collusion, or collaboration or a clandestine joint agreement or understanding in the matter.

Moreover, the appeal helped NCAA to arrive at the naked truth about the matter. NCAA rightly concluded that the download analysis and issuance of the falsified readout report for avionics equipment on the Sikorsky S76C+ helicopter with MSN 760486 and Reg. Mark 5N-BQG, was facilitated EXCLUSIVELY by the aircraft Owner/Operator, Eastwind Aviation Limited.

Hence, the appellate, which also is not another entity {perhaps the panel constituted to consider the appeal might be a new set of individuals different from the initial panelist} but still domiciled with the NCAA, reversed its earlier judgment with the latest one which absolved OBA of culpability in the infraction.

Excerpt from the Certified True Copy, CTC, of the final verdict as stated in the 28th of February 2025 letter to OBA stipulated among other things that:
*** There was no active participation by Omni-Blu Aviation in the series of events leading up to the . falsification of the readout report
*** There was no intention to falsify or knowledge of the falsification on the part of Omni-Blu Aviation.

EXPRESSION OF GRATITUDE
The management of Omni Blu Aviation, OBA, has expressed profound gratitude to the leadesrship at NCAA and especially to the appeal/review panel for their painstaking attention to details and the panelist avowed demination to uphold fairness with an ultra high sense of intergrity which unearthed the whole truth about the matter which in turn produced a fair judgement.

OBA also extends gratitude to its numerous clients, investors, business partners, friends and well wishers who showed concern in various forms while the company was engrossed in redeeming the stain from the initial pronouncement by NCAA.

Her news release narrated that “its worthy of note that 2025 will be the tenth (10) year since OBA obtained its AOC and started commercial flight operations, and never has she been implicated for any sharp practice or cutting of corners in order to obtain any certifications or approvals from the NCAA”.

OBA pledged to continue to place premium on safety, and compliance with all regulations. It is a company that holds itself to high ethical standards. She often conducts self audit.

The statement reaffirmed thus “Omni-Blu remains committed to its values, excellent service delivery, and compliance with regulation in the conduct of its business”.
