KQ LIVERY @ THE TAIL

Kenya Airways Livery

The Nigerian Civil Aviation Authority, NCAA, has imposed on Kenya Airways, KQ, a fine of 1000 Special Drawing Rights, SDR (1,391.50 United States Dollar)

According to the statement, the very mild penalty of 1000 SDR was for each of the three passengers whose rights, after careful investigation, were established to have been trampled upon with ignominy by Kenya Airways personnel and its agents, in the recent past.

The very terse statement from the NCAA said a formal letter in respect of the penalty of 1000 SDR had been transmitted since Wednesday, 7th May 2025, to Kenya Airways, over the cases of Gloria Omisore and two other passengers

The latest recommended compensation for lost baggage is 1500 SDR.

The statement in an unmistakable term explained that the airline, KQ, was found culpable not on a technical issue, but exclusively on consumer protection-related infractions.

Mr Michael Achimugu, (with a hat), the Director of Consumer Protection, NCAA, in a fact-finding meeting with Kenya Airways representatives at the preliminary level of investigation

After careful investigation, Nigeria CAA found beyond any reasonable doubt that KQ reneged on the right to care, woefully failed to provide full disclosure of terms of carriage, exhibited total disdain by not reacting to a formal communication, and as such willfully refused and also with disdain, failed to respond to the Authority’s request.

Also established beyond all reasonable doubt was Kenya Airways’ gross disregard for international protocols as sanctioned by the International Civil Aviation Organization, ICAO, and the International Air Transport Association, IATA, by willfully refused to process ticket refund, held on to passengers’ compensation when it fell due, and the inability to efficiently and effectively trace and retrieve missort baggage which ostensibly, and with time, fell under lost baggage.

Furthermore, a caveat in the letter goes thus, ”in addition to the fine in line with the NCAA Regulations 2023, the airline has seven days to pay the refunds and compensation of 1000 special drawing rights to the affected passengers”.

The letter, however, added that “Failure to comply with the letter will attract stiffer penalties for the airline”.

Succinctly put, a Fact-check by NTH as at Friday, 9th May 2025, revealed that for baggage that has been established lost, the recommended compensation is 1500 SDR.
